CBW Right to Manage (RTM) Roadmap Pre – 2009 Gross Fine is managing agent of Chelsea Bridge Wharf (CBW). 2009 Freeholder and developer of CBW Berkeley Homes sells off the head leases of five buildings (Centurion, Eustace, Horace, Howard and Oswald) to Fairhold Artemis Ltd, whose agent Estates and Management acts as landlord. Fairhold Artemis is a company controlled by the Tchenguiz Family Trust. CBW now has 4 landlords: Estates and Management, Genesis (Burnelli Building), London and Quadrant (Warwick Building) and Berkeley Homes (Lanson and Hawker Buildings). Estates and Management wishes to appoint sister company Consort Property Management (also controlled by the Tchenguiz Family Trust) as managing agent of CBW to replace Gross Fine who were under-performing (and now do not exist). The other landlords agree and Consort is duly appointed. Leaseholders are not consulted despite owning about 98% of the value of the development. 2010 Consort takes over the management at CBW. Charlie Garton Jones of Garton Jones Real Estate, concerned about the management at CBW, initiates a Right To Manage, and asks leaseholders to sign up. Over 50% of leaseholders in Centurion, Eustace, Horace, Howard, Lanson, Oswald and Warwick Buildings sign up as members of the Right To Manage Company, which is the threshold necessary to commence a Right To Manage (RTM) action. If RTM is successful the RTM Company, which must be set up, has the power to appoint and contract with a managing agent, to arrange insurance and also to fulfil other landlord duties. 2011 Chelsea Bridge Wharf RTM Company Ltd is incorporated. Leaseholders’ interests are represented by a Management Committee chaired by Mark Anderson. The RTM Company applies for RTM to the Leasehold Valuation Tribunal (LVT) for each of Centurion, Eustace, Horace, Howard and Oswald Buildings. The LVT awards the Company the right to manage those buildings. Fairhold Artemis, the other side, asks for leave to appeal. In preparation for RTM, the Management Committee starts a thorough search for a new agent, and invites a number of agents to tender. 2012 Fairhold Artemis is granted leave to appeal to the Upper Tribunal Lands Chamber. The Management Committee interviews a shortlist of agents and selects Rendall and Rittner as its preferred agent after a rigorous assessment. The RTM Company settles with Fairhold Artemis. Formally: “the CBW RTM Company reached an agreement with Fairhold Artemis Ltd, represented by Estates and Management Ltd, regarding the future management of Chelsea Bridge Wharf”. The choice of whether to retain Consort as agent or change to Rendall and Rittner is put to a vote of leaseholders. 97% of leaseholders vote to switch to Rendall and Rittner. 2013 On 1st January Rendall and Rittner starts the management of CBW. 2020 RTM Management Committee (ie CBWRA) agrees that it will submit a new application for RTM immediately upon changes to the law (that are intended to make the process easier for residents) take effect in what we expect to be 2023. In the interim CBWRA continues to lobby parliament.
